In Indian society, the issue of the adversarial system towards men in the legal process has become a significant and extremely worrisome issue. This system has been seen in many contexts where men have been unfairly marginalized and their rights have been harmed. One such new case came to light where the court ordered a husband to pay Rs 18 lakhs to his wife for the pending maintenance amount.
Advazeemkhan, a practicing lawyer, regularly shares informative videos on social media discussing various cases and laws. He frequently addresses instances of injustice toward men within the legal system. Recently, one of his hearings brought attention to this issue, which he elucidated further in one of his videos.
According to the video, he expresses concern about the injustice faced by boys under Indian law. He recounts a recent hearing where a boy had accumulated a maintenance debt of Rs 18 lakh. The monthly maintenance due to his wife was Rs 80 thousand, which the boy couldn’t afford, leading to the accumulation of the pending amount.
Now the boy argued with the judge in the council that Sir, we do not have that much money, now from where should we give it and how should we give it? The judge responded firmly, stating, “Regardless of your financial situation, the law mandates payment. Failure to comply may result in imprisonment.” Unfortunately, the boy had previously experienced incarceration. Such instances highlight the unjust treatment faced by individuals like him.
This case is interesting because it indicates the disputes and social inequality arising in society. On the men’s side, it is believed that such decisions unduly affect them and weaken their position in society. Thus, we need to move towards equality, justice, and harmony in society, so that every person can get full benefit of his rights and responsibilities. It’s imperative to address systemic issues to ensure fairness and equality in legal proceedings, safeguarding the rights of all individuals involved.
